These Terms & Conditions govern all bookings and services provided by Tafoukt Surf Experience, located in Imsouane Village, Chtouka Aït Baha Province, Morocco ("Tafoukt", "we", "us"). By submitting a booking enquiry or confirming a booking, you agree to these terms.
1. Bookings & Confirmation
A booking is considered confirmed only when you receive a written confirmation from Tafoukt by email. Provisional bookings are held for up to 72 hours pending deposit payment. After 72 hours without payment, the dates may be released to other guests.
A deposit of 30% of the total booking value is required to confirm your booking. The remaining balance is due no later than 14 days before arrival. For bookings made within 14 days of arrival, full payment is required at the time of booking.
2. Participant Requirements
- Minimum age: Participants must be at least 8 years old. Minors (under 18) must have written consent from a parent or legal guardian before instruction begins.
- Swimming ability: All participants must be able to swim at least 50 metres unassisted in open water. Surf lessons are not suitable for non-swimmers.
- Health: You are responsible for ensuring you are in good physical health and fit to participate in surf lessons. Please disclose any medical conditions, injuries, or medications to your instructor before the session. We reserve the right to refuse instruction to any participant whose safety may be at risk.
- Personal insurance: We strongly recommend that all participants purchase appropriate travel and activity insurance covering surfing, injury, and cancellation.
3. Equipment
Surfboards, leashes, and wetsuits (3/2mm and 5/4mm) are provided for all surf lesson and package guests. Equipment remains the property of Tafoukt Surf Experience. Participants are liable for the cost of repair or replacement of equipment damaged through reckless use or negligence, beyond normal wear and tear.
4. Photography & Media
During surf sessions, instructors or team members may take photos or video footage for training-feedback and marketing purposes. By participating, you consent to reasonable use of your likeness in promotional content. If you do not wish to be photographed, please inform your instructor before the session begins. Your objection will be respected without condition.
5. Liability
Surfing involves inherent risks including, but not limited to, collisions with surfboards, contact with the seabed, rip currents, and marine hazards. Tafoukt Surf Experience provides qualified instructors and appropriate safety supervision; however, participation is at your own risk.
Tafoukt shall not be liable for any personal injury, illness, loss, or damage to personal belongings arising from participation in surf activities, except where such injury or loss results directly from our proven gross negligence.
We are not responsible for any injury or loss caused by circumstances beyond our control, including weather conditions, ocean conditions, third-party actions, or force majeure events.
6. Force Majeure
If we are unable to provide booked services due to extraordinary circumstances beyond our reasonable control — including but not limited to severe weather, natural disasters, government travel advisories, civil unrest, or pandemic — we will offer one of the following at our discretion:
- Rescheduling of your booking to available dates within 12 months.
- A credit note valid for 12 months from the original booking date.
- A full refund where rescheduling is not feasible.
7. Changes to Your Booking
We will accommodate reasonable requests to change dates subject to availability. Date changes requested more than 14 days before arrival are free of charge. Changes requested within 14 days are subject to a €20 administration fee.
8. Conduct
We expect all guests to behave respectfully toward staff, other guests, and the local community of Imsouane. Tafoukt reserves the right to remove any guest from the programme without refund if their conduct is considered unsafe, abusive, or incompatible with the wellbeing of the group.
9. Governing Law
These Terms & Conditions are governed by the laws of the Kingdom of Morocco. Any dispute arising from a booking that cannot be resolved amicably shall be submitted to the competent courts of the Chtouka Aït Baha Province, without prejudice to your statutory rights as a consumer under the law of your country of residence.
